Introduction:
These terms and conditions of use (“Terms & Conditions”) are an agreement entered into by and between you (hereinafter referred to as "You" or “Your") and DNP Photo Imaging Europe SAS ("DNP PIE") for any and all software or patches (the "Software") downloadable from http://www.dnpphoto.eu website (the “Website”).

These Terms & Conditions constitute the entire agreement between You and DNP PIE and cancel any prior versions of the Terms. You also may be subject to additional terms and conditions that may apply when You use the Software.

DNP PIE offers various Software to download on its Website made by DNP PIE, Dai Nippon Printing Co., Ltd, its affiliate DNP Imagingcomm America Corp or any other affiliate and/or their commercial partners (“DNP PIE and its Partners”).
Specific license agreements (“Specific License Agreements”) are attached with certain Software and will require Your acceptance for downloading and using.

Article 1: Ownership Retained By DNP PIE
DNP PIE and its Partners grant You a non-exclusive, non-transferable license to install/use one copy of the Software in object code only. You agree to notify DNP PIE immediately of any breach of security here.

DNP PIE and its Partners own all titles and copyrights in and to the Software and they have the full right and authority to grant the license granted herein. Your license does not give You any title or ownership in the Software, nor is it a sale of any rights in the Software. The only right granted to You is the right to install/use the Software in accordance with these Terms & Conditions. All rights not specifically granted to You under these Terms & Conditions are reserved by DNP PIE and/or its Partners.

Subject to the provisions of Specific License Agreements, You may make only a single copy of the Software as a backup copy, provided that it includes all notices and markings, including copyright, trademark and other proprietary notices as on the original. Such backup copy of the Software may not be in use at any time unless the original Software is damaged beyond use, and both the original and the copy must remain in Your possession and control.

You may not copy the Software onto any public network. You may not allow others to modify, disassemble, decompile, translate, reverse engineer, reproduce, make derivative works of or enhance the Software. You may not, and You may not allow others to rent, lease, sell, sublicense, export or otherwise transfer the Software to any other person.

In addition to any other rights it may have, DNP PIE may terminate at its sole discretion the use of the Software if You fail to comply with the Terms & Conditions hereof. In such event, You must cease all use of the Software and destroy all copies of the Software and all of its component parts.

At DNP PIE's sole discretion, it may from time to time provide You with updates to the Software. Any such updates shall become part of the Software licensed to You and subject to all of these Terms & Conditions.

Article 2: Disclaimer of Warranties
DNP PIE and its Partners expressly disclaim any and all warranties relative to the Software. THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, COURSE OF DEALING AND USAGE OF TRADE. YOU HEREBY ASSUME THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE.

Article 3: Limitation of Liability
You must make every attempt to safeguard Your data and other files during installation, when upgrading, or when installing the Software or an update.

In no event shall DNP PIE and its Partners be liable for any direct, indirect, special, incidental, or consequential damages, theft, misuse, malfunction whatsoever to You (including, without limitation, deterioration of the hardware, damages for loss of profits, sales or data or for business interruption) arising out of the use of or inability to use the Software, even if DNP PIE and its Partners have been advised of the possibility of such damages. In any event, DNP PIE and its Partners’ entire liability under any provision shall be limited to the amount actually paid by You for the Software.

If any provision of these Terms & Conditions are declared by a court of competent jurisdiction to be invalid for any reason, such invalidity shall not affect the remaining provisions hereof.

Article 4: Indemnity
You agree to indemnify and hold DNP PIE and its Partners from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Your use of the Software, Your violation of the Terms, or Your violation of any rights of another.

Article 5: Intellectual Property
DNP PIE and its Partners are the respective owner of all copyrights, trademarks, and more generally, of all intellectual property rights of the Software and its content.

The Software is protected by copyright and/or other applicable law. Any use of the Software other than as authorized under this license or copyright law is prohibited. Any person violating this provision of these Terms & Conditions will be committing an infringement and be subject to legal action.

In accordance to national laws related to Intellectual Property, Your must not use our Software to violate any intellectual property rights, notably trademark, copyright, design, or the right to one's image, without the agreement of the rights’ holder. In no event shall DNP PIE and its Partners be liable for the use that you made of our Software regarding intellectual property right’s holder.

Article 6: Personal Data
The Website has been declared to the French National Commission on Data Protection and Privacy.

All personal data collected and gathered by DNP PIE is processed in as strictly private manner as possible. Article 7: Governing Law and Jurisdiction
These Terms & Conditions shall be governed by the laws of France without regard to conflict of laws principles. Any claim or litigation in connection with these Terms & Conditions shall be submitted to French jurisdictions.

Article 8: Taxes
You are responsible for all taxes or charges imposed by any government or regulatory authority with respect to the delivery and use of the Software, but exclusive of any taxes based upon the DNP PIE's net income.

Article 9: Term
DNP PIE and its Partners reserve their rights to release the Software under different license terms or to stop distributing it at any time, or to modify, suspend or terminate these Terms & Conditions, and/or Your use or/and access to the Software, with or without notice. DNP PIE and its Partners may also delete, or prevent access or use of, all related information and files.

DNP PIE and its Partners may terminate the Specific License Agreement if You breach any of the Terms & Conditions. Upon termination of this Specific License Agreement for any reason, You shall cease using the Software and, if applicable, return the Software to DNP PIE. All provisions of this Specific License Agreement relating to disclaimers of warranties, limitation of liability, remedies, or damages, and DNP PIE's proprietary rights shall survive termination.

DNP commercialise certains équipements, pièces détachées et accessoires liés à la photographie et
vend ses produits auprès d’une clientèle professionnelle en vue de la revente de ses produits à des
utilisateurs professionnels.
 
DNP attache une grande importance à la protection des données personnelles et au respect de la
législation applicable, notamment aux principes édictés par le Règlement Général sur la Protection
des Données n°2016/679 du 27 avril 2016 (ci-après « RGPD ») et par la loi n°78-17 du 6 janvier 1978
(dite loi « Informatique et Libertés ») dans sa version modifiée.
 
La présente Politique de protection des données personnelles s’applique à l’ensemble des données
personnelles qui sont collectées et traitées par DNP, en qualité de responsable de traitement, via son
site internet et également via les autres canaux, et notamment lors de salons professionnels,
communication sur les réseaux sociaux, contacts et échanges avec les clients ou les prospects dans
tous les pays européens.
 
Les informations recueillies via les cookies de notre site internet font l’objet de clauses particulières

Quelles données sommes-nous amenés à collecter ?
 
DNP peut être amenée à collecter et traiter des données personnelles dans le cadre de ses activités

- numéro de téléphone professionnel
- les cartes de visites ou le poste occupé au sein d’une société
- le pays de résidence
- les curriculum vitae qui nous sont envoyés

Lors que DNP collecte des données personnelles, les personnes concernées sont informées par des
mentions figurant sur les formulaires prévus à cet effet, conformément à la législation applicable.
 
Dans les cas où le consentement de la personne est requis en vertu des principes du RGPD, DNP
s’engage à respecter les formes de recueil de ce consentement afin que celui-ci soit donné de façon
libre et éclairé et le droit pour toute personne de retirer son consentement à tout moment.
 
 
Pour quelles finalités des données personnelles sont-elles collectées ?
 
DNP peut être amenée à utiliser les données personnelles collectées pour les finalités suivantes :
- enregistrer des commandes et fournir les produits ou services correspondants ;
- gérer les demandes, commandes, paiements, livraisons et retours/échanges de produits ou
services ;
- assurer le support client afin de pouvoir résoudre un problème technique qui a été signalé
par un partenaire ;
- permettre l’accès à son site internet ou à des informations ou services accessibles sur des
espaces réservés dudit site ;
- envoyer une newsletter pour communiquer sur ses produits et services ;
- communiquer sur des actions promotionnelles sur ses produits et services ;

des personnes concernées ;
- permettre l’achat ou la mise à disposition de licence de logiciel en lien avec les produits et
services proposés par DNP ;
- répondre à toute demande de contact ou question qui lui est adressée.
 
Certains des traitements réalisés par DNP conformément aux finalités énoncées ci-avant sont
nécessaires pour permettre à DNP de :
- remplir ses obligations contractuelles vis-à-vis de ses clients, partenaires et fournisseurs ;
- respecter les obligations légales qui lui incombent, notamment en termes de garantie, de
SAV, de fiscalité et de comptabilité ;
- répondre à certains intérêts légitimes relatifs notamment à la gestion de ses activités
commerciales.
 
Dans tous les autres cas, les traitements réalisés par DNP sont possibles dans la mesure où la
personne concernée y a expressément consenti.
 
DNP n’utilise pas les données personnelles en vue de leur revente à des tiers.
 
 
A qui communique-t-on les données personnelles collectées ?
 
DNP peut communiquer les données personnelles qu’elle collecte aux autres sociétés du groupe DNP
et notamment à la société-mère située au Japon. Les communications effectuées vers le Japon sont
encadrées par des clauses contractuelles types établies par la Commission Européenne,
conformément à la législation applicable.
DNP peut également être amenée à communiquer les données personnelles qu’elle collecte à des
sous-traitants, partenaires ou prestataires de service situés en Europe lorsqu’elle fait appel à un tiers
pour exécuter une prestation en lien avec une des finalités décrites ci-dessus (par exemple : livraison
d’un produit). Dans ce cas, un contrat est conclu avec chaque sous-traitant, partenaire ou prestataire
de service afin que ce dernier s’engage à garantir la sécurité et la confidentialité des données qui lui
sont transférées à respecter la réglementation applicable, et du RGPD en particulier.
 
 
Combien de temps les données personnelles sont-elles conservées ?
 
DNP conserve les données personnelles qu’elle traite pour la durée nécessaire aux finalités telles que
décrites ci-dessus, dans le respect des principes énoncés par le RGPD, sans préjudice de dispositions
législatives ou règlementaires propres à certaines catégories de données imposant une durée de
conservation particulière ou la suppression de ces données.
 
Les données personnelles relatives aux clients ou prospects ne seront pas conservées au-delà de la
durée de conservation strictement nécessaire à la gestion de la relation commerciale, à l’exception
de celles nécessaire à l’établissement de la preuve d’un droit ou d’un contrat.
 
Les données personnelles sont conservées par DNP pour les durées suivantes :
 
- Données relatives aux clients :
toute la durée de la relation commerciale + 36 mois depuis le dernier contact
 
- Données relatives aux prospects :
36 mois depuis la dernière communication
 
- Données bancaires : 
13 mois depuis leur fourniture
 
- Pièce d’identité fournie pour l’exercice des droits RGPD : 
1 an depuis sa communication
 
- Données archivées ayant fait l’objet de l’exercice du droit d’opposition au traitement :
6 ans depuis l’archivage
 
- Données de connexion au site internet DNP :
36 mois depuis la dernière connexion
 
- Cookie DNP : 
13 mois depuis son installation
 
- CV et candidatures : 
2 ans à compter du dernier contact du candidat
 
Une fois la durée de conservation mentionnée ci-avant atteinte, DNP pourra procéder à l’archivage,
pour une durée supplémentaire maximale de 10 ans, des données qui sont soumises à une obligation
légale de conservation ou présentant un intérêt administratif (gestion d’un éventuel contentieux,
procédure fiscale…).
 
 
Quels sont les engagements de DNP en matière de sécurité ?
 
DNP s’engage à prendre toutes les mesures techniques et organisationnelles pour assurer la
protection et la sécurité des données personnelles, en particulier contre toute perte, altération,
diffusion ou usage illégal.
 
DNP s’assure que de telles mesures sont mises en place sur l’ensemble des opérations réalisées dans
le cadre de ses traitements, et notamment lors de la collecte des données personnelles, de leur
stockage et de leur hébergement.
 
DNP s’assure également que les tiers auxquels elle est susceptible de faire appel (prestataires
techniques, fournisseurs…) respectent cette exigence de protection des données personnelles par la
mise en place de mesures appropriées, conformément au RGPD.
 
 
Quels sont vos droits et comment les exercer ?
 
Conformément au RGPD et à la loi « Informatique et Libertés » modifiée, toute personne peut
obtenir accès et communication et, le cas échéant, rectification ou suppression des données
personnelles la concernant, en s’adressant à DNP. Vous pouvez également, pour des motifs légitimes,
vous opposer au traitement des données vous concernant.
 
En outre, selon les modalités prévues par le RGPD, nous vous rappelons que vous disposez du droit
d’obtenir l’effacement de vos données personnelles lorsqu’elles ne sont plus nécessaires au regard
des finalités pour lesquelles elles ont été collectées, du droit à la limitation du traitement si vous
constatez que vos données seraient inexactes, ainsi que du droit à la portabilité de vos données.

Dye-sublimation Media

Dye-sublimation diffuses dye, using ribbon onto paper. Heat is applied to the ribbon and that converts the dye to gas which is, in turn, absorbed into a specialized receiving layer on the paper.

Dye layers are then sealed into the paper to protect against UV light, fingerprints, and even water. Unlike ink technologies, there is no smudging, running, or blotching because prints are dry and ready to touch as soon as they leave the printer.
